Detailed description of role The role is based at the head office of Siemens Mobility, Malaysia, in Kuala Lumpur. You will be part of the Legal and Contract Management team in Asia Pacific (APAC), reporting functionally to the Head of Legal, APAC. Your in-country manager will be the Chief Executive Officer of Siemens Mobility, Malaysia. This role requires you to provide legal support for bids in private or public tenders and any partnership arrangements in Malaysia and potentially, in the APAC region, contract management support in project execution once a project is awarded and (c) on any corporate related matters. Bids and partnership arrangements: You will support the bid team in contract review and advise them on legal risks. This will involve a detailed review and negotiation of supply and services contracts, memorandum of understanding, consortium agreements, non-disclosure agreements, term-sheets, and procurement contracts. This also entails identifying and presenting legal risks, mitigations and opportunities for internal approval. Project execution: You will support the project team in managing various rail projects in the execution phase. You are required to advise the commercial, technical and procurement team members on the company’s legal obligations and entitlement under the contracts and drive the strategic direction of managing risks and opportunities. This also entails preparing and responding to all claims and correspondence of the customer, sub-contractors and suppliers (including related entities) on time, and engaging these parties in negotiations and drafting any settlement agreements. These include addressing issues relating to financial and commercial instruments such as bonds, insurance, guarantees and letters of credit. Regular reporting on project status is required. Corporate matters: Providing advice to internal stakeholders on employment, antitrust, corporate secretarial and other general corporate matters. Managing external counsel in litigations, arbitrations and adjudications, where required. Actively collaborating and sharing knowledge with the rest of the legal and contract management team members in the APAC region, across regions and in headquarters. Preparing and conducting legal and contract management training or contract reading for new projects for project team members. Occasional travel may be necessary in the APAC region. The person we are looking for At least 3 years post-qualification experience doing litigation or arbitration for a reputable law firm, preferably in the area of infrastructure and construction disputes, or having at least 5 years working experience in a contract management role in infrastructure projects. Able to consistently provide practical and commercially driven solutions. Detail oriented, strong drafting skills and able to work independently. Keen interest to learn new fields of work (especially technology in the industrial space) and where necessary, participate in novel projects in the APAC region. Strong desire to collaborate with multiple stakeholders across different countries. Willing to engage and advise senior local management on a regular basis in particular, the Chief Executive Officer and Chief Financial Officer.
