The Role
To support Trade Center of Excellence (TCOE) compliance and export control team, with duties in Commerce, State, and Treasury licensing areas. This includes dual-use and munitions license jurisdiction and determination and export compliance areas. This role will also provide training on jurisdiction, classification, licensing procedures, export regulations, and overall trade compliance to support the enterprise.
Job DutiesThe incumbent is a global expert on US and non-US export control issues to ensure that Caterpillar complies with all applicable U.S. Export Control laws and regulations on a world-wide basis. This will mainly focus on dual-use and munitions lists classification and licensing determination, and export compliance. The classification of dual-use items will include all possible categories into which Caterpillar equipment, parts, technology, and software may fall.
Address complex and detailed classification and licensing questions from varying audiences to include management and peers, and representatives from across Caterpillar, utilizing knowledge gleaned from relevant government regulations.
Interpret regulatory policies and evaluation of proposed exports and on technical portions of relevant government guidelines that affect the enterprise.
Work very closely with the Business Units to execute a successful Export Controls compliance program. At the core of the Export Controls Compliance Program is the Caterpillar Enterprise U.S. Export Control Program Manual which outlines the program standards and specifically identifies the Caterpillar operating procedures.
Support the Business Unit Export Control Program Managers compliance activities which include the following:
• Export Classification
• Export Licensing
• Technology & Deemed Export
• Country Based Controls
• IT Systems & Transfer
• Export Recordkeeping
Work consists of recurring classification, review of technical specifications for items, parts, and technology and training objectives. This work is characterized by exceptional breadth, requiring intensity of effort, and consisting of multiple phases.
Must conduct extensive analysis of the nature and scope of problems to make decisions on export jurisdiction, classification, relevant licensing requirements, and associated compliance aspects.
Duties will include classification of all items (i.e. technology, commodities, parts and components, etc.) prior to assignment of product number, and to provide guidance on the export of items. This will be done by daily monitoring and review of the auto-class system and manual classification requests. Duties will also include the drafting and review of policies, procedures, and classification criteria for an in-house auto-class IT system and for manual classifications of dual-use and munitions items for which the enterprise is responsible and liable.
The incumbent uses guidelines such as all relevant export control regulations, broad policy statements, basic legislation, recent scientific findings, or reports, often ambiguous in nature and requiring extensive interpretation. The incumbent uses judgment and ingenuity and exercises broad latitude to interpret new or revised professional standards and codes, guidelines, policy statements or regulations.
